Content is provided for informational purposes only and does not create a binding offer, proposal, warranty, or contract. Any services we provide to clients will be governed by separate written agreements (for example, a Master Services Agreement and Statement of Work).

6) SMS AND TEXT MESSAGING TERMS
This section applies if you provide a mobile phone number, communicate with us by text message, or opt in to receive SMS or other text messages from Traverciti (the “SMS Program”).
6.1 Brand Name
Messages are sent by Traverciti LLC.
6.2 Types of Messages
You may receive messages such as:
Responses to your inquiries and requests
Scheduling and coordination messages
Service-related or administrative updates
Account, project, or support communications (if applicable)
Marketing or promotional messages, where permitted and only if you have opted in where required
6.3 Message Frequency
Message frequency varies based on your interactions with us.
6.4 Message and Data Rates
Msg & data rates may apply. Your mobile carrier may charge fees for sending or receiving text messages.

6.6 Opt-Out
You can opt out at any time by replying STOP. You may also opt out using common opt-out keywords such as END, QUIT, CANCEL, UNSUBSCRIBE, OPT OUT, REVOKE. After you opt out, we may send a single confirmation message and then stop sending further SMS messages to that number, except where necessary for legal or administrative purposes.
6.7 Re-Opt In
If you opt out and later want to receive messages again, you may reply START (where supported) or contact us to re-enroll, and we will confirm your opt-in as required.
6.8 Consent and Eligibility
By providing your mobile number and opting in where required, you authorize Traverciti to send you text messages as described in these Terms. Your consent is not a condition of purchasing any services.
You represent that you are the account holder for the number provided or that you have authorization to enroll that number.
6.9 Carriers and Delivery
Carriers are not liable for delayed or undelivered messages. Message delivery is subject to your carrier’s network availability.
6.10 Compliance and Registration
Where required by applicable industry rules, carriers, and laws (including A2P messaging requirements), Traverciti will register messaging campaigns and maintain appropriate opt-in, opt-out, and compliance controls.
7) Intellectual Property
Unless otherwise stated, the Services and all content included in them, including text, graphics, logos, designs, and layout, are owned by Traverciti or licensed to us and protected by intellectual property laws.
You may use the Services for lawful, internal evaluation purposes. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content without our prior written permission, except as permitted by law.
8) Acceptable Use
You agree not to misuse the Services. You will not, and will not attempt to:
Use the Services unlawfully
Interfere with security, integrity, or performance
Introduce malware or harmful code
Attempt unauthorized access to systems or networks
Use automated means to extract data without written permission
Send spam, fraudulent, or misleading communications
9) Third-Party Services
The Services may reference or link to third-party services. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk.
10) Confidential Information and Unsolicited Submissions
Do not submit confidential, sensitive, or proprietary information through general communications unless we have expressly requested it and provided a secure method.
If you submit ideas, suggestions, or feedback that we did not request (“Unsolicited Submissions”), you grant Traverciti a non-exclusive, worldwide, royalty-free, perpetual right to use, reproduce, modify, publish, and distribute those Unsolicited Submissions without compensation to you, to the extent permitted by law.
11) Disclaimers
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Traverciti disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any content is complete, accurate, or up to date.
12) Limitation of Liability
To the maximum extent permitted by law, Traverciti will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of, or inability to use, the Services.
To the extent liability cannot be excluded, Traverciti’s total liability for any claim related to the Services will not exceed USD $100.
13) Indemnification
You agree to defend, indemnify, and hold harmless Traverciti and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms, your misuse of the Services, or your infringement of any rights of another party.
14) Suspension and Termination
We may suspend or terminate access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, if required for security reasons, or if required by law.
15) Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
16) Miscellaneous
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
No Waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later.
Entire Agreement: These Terms constitute the entire agreement between you and Traverciti regarding your use of the Services, unless you have a separate written agreement with us covering specific services.
